The Transylvania County Board of Commissioners hereby gives notice of a public hearing in accordance with NC General Statute § 153A-123. The purpose of the public hearing is to receive input on the County’s compliance with new legislation to cite the statutory reference to the penalty for violation of the Buildings: Construction and Related Activities Ordinance.

The proposed amendment to the Buildings: Construction and Related Activities Ordinance reads, with the changes noted in bold and italics: 4-76-Any violation of this article or failure to comply with any of its requirements shall constitute a misdemeanor pursuant to North Carolina General Statute § 14-4. Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be punished as provided in section 1-8 and, in addition, shall pay all costs and expenses involved in the case. Each day such violation continues shall be considered a separate offense. Nothing herein contained shall prevent the county from taking other lawful action as is necessary to prevent or remedy any violation. (Ord. of 3-27-95)

The public hearing shall be held on Monday, December 13, 2021 at 4:00 P.M. in the County Commissioners Meeting Chambers, located at the Transylvania County Administration Building, 101 S. Broad St., Brevard, NC.
